ABSTRACTIn this course, Chen Weizuo examines some general and special issues of the new codification of Chinese private international law and focuses on China's new private international law. The author discusses the need for codification of the rules of law because, historically, China has had a tradition of written law. He focuses on the symposia, meetings, and doctrinal debates on the codification of Chinese private international law that preceded the legislative process for the adoption of new rules of conflict in China. The author highlights the particularities of new Chinese private international law, including the introduction of ten general articles to compensate for the absence of general provisions and institutions. He deals with the main provisions of the general part, which include the laws of immediate application of the Forum State, as well as the Sachnormverweisung and the Gesamtverweisung laws. The author also comments on the main provisions of the special part of the new codification, concluding with a discussion on the codification with international treaties and multilateral agreements as the sources.
RÉSUMÉCe cours a pour objet d’apporter une analyse du processus de codification du droit international privé chinois, en commençant par expliquer la nécessité d’une telle codification via une approche historique puis contemporaine. Un descriptif des propositions doctrinales ainsi que de la procédure législative de la nouvelle codification du droit international privé chinois est donné par le Professeur.Il convient ensuite d’étudier le contenu de la nouvelle codification par thèmes ainsi que les grands principes qui s’appliquent au système chinois de droit international privé général, puis spécial. Enfin, la question de la relation entre cette nouvelle codification et la codification internationale, au moyen de conventions internationales, est abordée.
