ABSTRACTDidier Opertti Badán presented this course on the conflict of laws and uniform law in contemporary private international law at the 2012 inaugural conference. According to the author, the conflict of laws and jurisdictions are two autonomous legal categories that require a specific approach and respective technical solutions. He does so without denying the link that exists between them, which can change according to the legal relationship in question. The author emphasizes on the vastness and diversity of the conflictualist case law, which is, of course, very broad, as well as like the one that arises from the uniform rules. He discusses the two founding visions of private international law: one which defines it as a right between the States and the other which shows it as a right between individuals when their private relations are established. It is necessary to take into account that solutions of conflict of law and the direct rules can be unified. There may be some general principles that emerge from the uniform law.
RÉSUMÉCette conférence inaugurale donnée pour l’ouverture de la session de Droit International Privé de l’Académie de Droit International en 2012, porte sur le conflit de lois et le droit uniforme, notamment le conflit de juridiction. Ainsi, en prenant en compte les doctrines les plus répandues, la partie la plus importante de la conférence porte sur les rapports entre les règles matérielles uniformes et les règles de conflit. La convention des Nations unies sur les contrats de vente internationale de marchandises est utilisée comme exemple et point de réflexion. La conférence se termine sur les conceptions des droits humains, de la diversité culturelle en droit international ainsi que sur une réflexion sur la conception « économiciste » ainsi que les enjeux actuels du droit international privé.
