ABSTRACTBy starting with an historical overview, the class looks into the position of the individual in international relations and international law. The development of an individual oriented approach in international law is linked to the emergence of democracy and accountability. After that, the issues related to legal duties imposed to individuals are studied, leading to a discussion on international criminal law. By a comprehensive approach of the articulation of an individual or group interest, is addressed the topic of the participation of individuals in the creation of international law. After that, the exercise of control over the attitude of States and international organizations by individuals is questioned, as well as the duty of States over individuals.
RÉSUMÉDans ce cours, l’auteur informe que l’émancipation de l’individu de l’État en termes juridique est assortie de la notion de la personnalité juridique internationale des individus. Il commence par examiner les divers concepts qui ont été utilisés pour expliquer la position de l’individu dans les relations internationales et le droit international dans une perspective historique. L’auteur examine le développement du droit international depuis ses débuts vers l’octroi d’un statut juridique particulier aux personnes aujourd'hui et le développement d’une approche orientée individuelle. Il traite des questions relies aux obligations légales imposées aux individus par le droit international. En outre, l’auteur aborde la question de la participation des individus à la création du droit international. Il examine également l’exercice du contrôle par des individus sur l’attitude des États et même des organisations internationales afin de discuter de la question de l’obligation des États vers les individus.
