ABSTRACTIn this course, Angelo Davi devotes a few developments to the study of the field of application that modern regulations of conflict of laws grant to the renvoi as well as the examination of some of the rather complex problems of its practical operation. The author begins with an introduction to the evolution of ideas on the Doctrine on renvoi and then traces the origin of the problem of renvoi and the historical development of ideas about it. He discusses the modern functional design of renvoi and the diversification of national solutions, focuses on the legal systems that are unfavorable and favorable to renvoi, and analyzes the two models of first-degree renvoi. The author compares various national regulations regarding a second-degree renvoi and considers the position of renvoi in international conventions and in European Union Acts relating to private international law. He concludes by analyzing and systematizing the main categories of conflict rules or concrete situations whose compatibility with the renvoi is open to discussion or outrightly excluded.
RÉSUMÉLe vaste sujet du renvoi en droit international privé est abordé en introduction via une approche historique et fonctionnelle des théories sur le sujet.Le cours commence avec une étude des conceptions nationales du renvoi en droit international privé. Les différentes conceptions du renvoi, ont évolué vers une conception fonctionnelle moderne, menant à des solutions différentes pour chaque système juridique national. Une analyse approfondie des systèmes de renvoi au premier degré, puis au second degré est effectuée via à la fois une étude théorique et pratique de la question.S’en suit une étude des conventions internationales et des actes de l’Union Européenne sur la question du renvoi, et des différentes formes que peut prendre ce dernier. Ce cours se termine avec la délimitation et l’explication des domaines d’application du renvoi, ainsi que les spécificités propres à certains domaines de renvois.
