ABSTRACTThe course of Emmanuel Decaux, Professor at the University of Paris II, focuses on public international law relating to slavery, which does not constitute a historical review of the issue of slavery. The abolition of slavery has not only been linked to the ideology of human rights since the Enlightenment, but also corresponds to a profound questioning of the very nature of modern international law. In this course, Professor Decaux identifies the concepts of slavery and trafficking in international law according to four complementary perspectives: a historical approach with the general problem of the abolition of the trafficking and slavery in public international law, a formal approach with the technical construction of a multilateral framework, a substantive approach marked by the progressive constitution of an international regime, and finally an operational approach through the implementation of international responsibility.
Le cours d'Emmanuel Decaux, professeur à l'Université Paris II, porte essentiellement sur le droit international public relatif à l'esclavage et ne constitue pas un bilan historique de la question de l'esclavage. L'abolition de l'esclavage n'est pas seulement liée à l'idéologie des droits de l'homme depuis le siècle des lumières, elle correspond également à une interrogation profonde sur la nature même du droit international moderne. Dans ce cours, le Professeur Decaux cerne les notions d'esclavage et de traite en droit international selon quatre perspectives complémentaires : une approche historique avec la problématique générale de l'abolition de la traite et de l'esclavage en droit international public, une approche formelle, avec la construction technique d'un cadre multilatéral, une approche substantielle, marquée par la constitution progressive d'un régime international, et enfin une approche opérationnelle, à travers la mise en œuvre de la responsabilité internationale.
