ABSTRACTPaul Beaumont's course deals with the jurisprudence of the European Court of Human Rights on the Hague Convention on the Civil Aspects of International Child Abduction, and the influence of the jurisprudence on the decisions of the European Court of Justice. After an in-depth study of the cases before the European Court of Human Rights on the Hague Convention and the place of this Convention in the Court's reasoning (in particular with regard to Articles 6 and 8 of the European Convention on Human Rights), Professor Beaumont provides some illustrations of the impact of the decisions of the European Court of Human Rights on the application of the Hague Convention on International Child Abduction. He then focuses on the jurisprudence of the European Court of Justice.
Le cours de Paul Beaumont concerne la jurisprudence de la Cour européenne des droits de l'homme relative à la Convention de La Haye sur les aspects civils de l'enlèvement international d'enfants, et l'influence de cette jurisprudence sur les décisions de la Cour de justice de l'Union européenne. Après une étude approfondie des affaires soumises à la Cour européenne des droits de l'homme à propos de la Convention de La Haye et de la place de cette convention dans le raisonnement de la Cour (notamment en ce qui concerne les articles 6 et 8 de la Convention européenne des droits de l'homme), le Professeur Beaumont fournit quelques illustrations de l'impact des décisions de la Cour européenne des droits de l'homme relatives à l'application de la Convention de La Haye sur l'enlèvement international d'enfants.
