ABSTRACTIn this course Yves Lequette, Professor of the University of Paris II, reports on the constant expansion of the place that is occupied by conventions in contemporary international law, in particular in with respect to family law. On the debit side: the deterioration that this causes with respect to the coherence of the domestic order. On the credit side: thanks to the international conventions, it is possible to overcome the discontinuity of legal order and to remove the disadvantages that this inflicts on the individual. Professor Lequette elucidates his ideas in three chapters: the pitfalls of utilitarianism, the narrow path of compromise, and the limits of unification.
Yves Lequette, Professeur de l’Université de Paris II, présente dans ce cours un bilan de l’expansion constante de la place qu’occupent dans le droit international contemporain, notamment en droit de la famille, les sources conventionnelles. Au passif : l’altération que le mouvement conventionnel inflige à la cohérence des ordres internes. À l’actif: grâce aux conventions internationales, il est possible de vaincre la discontinuité des ordres juridiques et de supprimer les inconvénients que celle-ci inflige aux individus. Le Professeur Lequette précise les choses en trois chapitres: les pièges de l’utilitarisme, la voie étroite du compromis, et les limites de l’unification.
