ABSTRACTUnlike other goods, a work of art is unique. As Kurt Siehr, Professor at the University of Zurich points out, this explains to a large extent the legal problems attached to the international art trade. Professor Siehr outlines these problems, first paying attention to the art trade in fakes, wrongly attributed works of art and works of art of dubious provenance. The author then raises the problem of art trade in stolen works of art, and of works of art removed in times of war, armistice and occupation. Kurt Siehr also develops the subjects of art trade in works of art that have been nationalized or expropriated, art trade in works of art that have been removed from territories before their independence, and art trade in works of art that have been illegally exported.
Contrairement aux autres biens, l’oeuvre d’art est unique. C’est en grande partie ce qui explique, relève Kurt Siehr, professeur à l’Université de Zurich, les problèmes juridiques liés au commerce international d’oeuvres d’art. Le Professeur Siehr expose ces problèmes en s’intéressant tout d’abord au commerce des faux, au commerce des oeuvres incorrectement attribuées, et au commerce des oeuvres de provenance douteuse. L’auteur aborde ensuite la question du commerce des oeuvres volées, celle du commerce des oeuvres d’art déplacées en tant de guerre, d’armistice ou d’occupation. Kurt Siehr consacre également des développements importants au commerce des oeuvres d’art ayant fait l’objet d’une nationalisation ou d’une expropriation, au commerce d’oeuvres d’art sorties du territoire avant l’indépendance de ceux-ci, et au commerce d’oeuvres d’art exportées illégalement.
