ABSTRACTThe European Community has developed a set of rules relating to products liability that is unique in the world. The European consumer product liability law is the object of this course by J.J. Fawcett, Professor at the University of Leicester. The author first of all presents the substantive law background in Europe and its significance for private international law. Professor Fawcett then pays attention to problems of jurisdictional competence and possible solutions in this matter and to forum shopping, before looking into the question of conflicting laws with regard to non-contractual liability.
La Communauté européenne a développé une corps de règles relatives à la responsabilité du fait des produits qui n’a pas d’équivalent dans le monde. Le droit européen de la responsabilité du fait des produits de consommation est l’objet du cours de J.J. Fawcett, professeur à l’Université de Leicester. L’auteur présente tout d’abord le droit matériel communautaire et la signification de ce droit matériel pour le droit international privé. Le Professeur Fawcett s’intéresse ensuite aux problèmes de compétence juridictionnelle en la matière et aux solutions possibles, au forum shopping, ainsi qu’aux questions de conflits de lois en matière de responsabilité non contractuelle.
