ABSTRACTAccording to Paul Volken, Professor at the University of Fribourg, three reasons justify a new presentation of international bankruptcy law within the Academy: the European Convention held on 5 June 1990 on certain international aspects of the bankruptcy law, the tendency within the European Communities to resume the Community project on bankruptcy, and recent political developments in Eastern Europe. Professor Volken focuses on three aspects: a brief inventory of the principles that have dominated the discussion on international bankruptcy, a commentary on the ongoing efforts to review the progress and to highlight the main challenges which they have encountered so far, and identification of the points on which a future discussion of cooperation in this area should be focused.
Selon Paul Volken, Professeur à l'Université de Fribourg, trois raisons justifient une nouvelle présentation du droit international de la faillite au sein de l'Académie : la Convention européenne du 5 juin 1990 sur certains aspects internationaux du droit de la faillite, la tendance au sein des Communautés européennes à reprendre le projet communautaire sur la faillite, et les récents développements politiques en Europe de l'Est. Le Professeur Volken se concentre sur trois aspects : un bref inventaire des principes qui avaient dominé jusqu'à maintenant la discussion en matière de faillite internationale, un commentaire des efforts en cours de dresser un bilan de leur état d'avancement et de signaler les principales difficultés auxquelles leur réalisation s'est heurtée jusqu'à maintenant, la détermination des points sur lesquels une future discussion de coopération en la matière devrait se concentrer.
