ABSTRACTProfessor Frank Vischer remarks in the introduction to his general course on private international law that private international law was and remains one of the most debated among all the branches of law and that there is still no general agreement on the principles, methods and objectives of conflict of laws. History has shown that once any agreement has been attained, it is challenged by the next generation of conflicts lawyers. The author develops his course around the themes of the American Revolution and its consequences, conflict of laws in the courts, the bilateral conflict rule and the substantive result, and foreign public law and conflict of laws. In the last chapter he examines the relation between adjudicatory jurisdiction, choice of law, and recognition and enforcement of decisions.
Frank Vischer, professeur à l’Université de Bâle, fait remarquer en introduction de son cours général de droit international privé que la question du droit international privé est l’une des plus débattues et qu’il n’y a toujours pas d’accord général en ce qui concerne les principes, les méthodes et les objectifs du conflit de lois. Chaque accord apparu au cours de l’histoire a été contredit par la génération suivante de juristes. L’auteur développe son cours en présentant successivement la révolution américaine et ses conséquences, les conflits de lois devant les juridictions, le conflit de loi bilatéral et son résultat matériel, le droit public étranger et le conflit de lois. Il s’intéresse enfin dans son dernier chapitre aux relations entre la compétence juridictionnelle, le choix du droit applicable, la reconnaissance et l’exécution des décisions.
