ABSTRACTThe subject of Philippe Cahier’s course, Professor at the Graduate Institute of International Studies in Geneva, is to examine whether, following the Second World War and the upheavals it caused, and taking into account the origin of international law, the course has subjected to profound changes or whether, apart from criticisms which are often hasty and which are addressed to him, the course has only been a matter of minor modifications with a view to adapt it to new needs. Philippe Cahier chooses to devote his general course on public international law to aspects of international law which, in his opinion, remain fundamental, namely the sources of international law, liability, and the settlement of disputes. These developments are preceded by a study of the main principles of international law.
Le thème du cours de Philippe Cahier, professeur à l’Institut universitaire des hautes études internationales de Genève, est de vérifier si à la suite de la seconde guerre mondiale et des bouleversements qu'elle a provoqués, et compte tenu de l'origine du droit international, celui-ci a subi des mutations profondes ou si, au-delà des critiques souvent hâtives qui lui sont adressées, il ne s'est agi que de modifications somme toute mineures en vue de son adaptation à de nouveaux besoins. Philippe Cahier fait le choix de consacrer son cours général de droit international public à des aspects du droit international qui selon lui demeurent fondamentaux, à savoir les sources du droit international, la responsabilité et le règlement des différends. Ces développements sont précédés d’une étude des grands principes du droit international.
