ABSTRACTPeter Hay, Professor at the University of Illinois at Urbana-Champaign, emphasizes in the introduction to his course that a contradiction between the need for flexibility (to avoid an unfair decision) and the need for legal certainty cannot be resolved. It is the natural consequence of the difference between the development of law and the application of law. Legal systems have taken into account the contradiction between legal certainty and individual justice in the context of domestic law. Professor Hay examines how the contradiction is dealt with American law and European law of conflict of laws. He is successively interested in the forum and the law, the objectives of determining the applicable law, and finally the difference in approach to legal certainty on both sides of the Atlantic.
Peter Hay, Professeur à l'Université d'Illinois à Urbana-Champaign, souligne en introduction de son cours que l'opposition entre le besoin de flexibilité (pour éviter une décision injuste) et celui de sécurité juridique est une tension que l'on ne peut résoudre. Elle est la conséquence naturelle de la différence entre l'élaboration du droit et l'application du droit. Les systèmes juridiques ont pris en compte cette tension entre sécurité juridique et justice individuelle dans le contexte du droit interne. Le Professeur Hay étudie la manière dont cette tension est traitée dans le droit américain et les droits européens des conflits de lois. Il s'intéresse ainsi successivement au for et à la loi, aux objectifs de la détermination du droit applicable, et enfin à la différence d'approche que l'on a de la sécurité juridique de part et d'autre de l'Atlantique.
