ABSTRACTIn his course, Antonio Malintoppi, Professor at the University of Florence, describes the work relations as a characterized legal relation established between a worker and an employer in accordance with the law. It is therefore a well-defined as well as technical concept. The author places the work relations always in the context of labor law. In order to carry out his study, Professor Malintoppi begins his course with the presentation of the general problems of private international labor law. He then focuses on lex fori, the structure of work relations, and the problem of qualifications. He examines the connecting elements and finally discusses the problems concerning the choice and application of foreign law.
Dans son cours, Antonio Malintoppi, professeur à l’Université de Florence, désigne sous le terme de rapports de travail le rapport juridique caractérisé qui s’établit entre un travailleur et un employeur conformément à la loi. Il s’agit donc d’une notion qui est étroite aussi bien que technique. L'auteur situe ces rapports de travail toujours dans le contexte du droit du travail en général. Pour mener à bien son étude, le Professeur Malintoppi commence donc par exposer les problèmes généraux du droit international privé du travail. Il s'intéresse ensuite à la lex fori, à la structure des rapports de travail et au problème des qualifications. Il étudie ensuite les éléments de rattachement et enfin expose les problèmes concernant le choix et l’application de la loi étrangère.
